Abstract
The U.S. Supreme Court's decision in TikTok v. Garland highlights the challenging balance between digital sovereignty, national security, and freedom of expression. The analysis develops by considering the impact of technology on the rule of law and the geopolitical tensions related to foreign influence. At the core, there is the constitutional balancing between the protection of security and fundamental rights, with a comparison between the U.S. and EU on the handling of user data collected by digital platforms.
